These Terms & Conditions (“Terms”) are an agreement between you and K3 Commerce, LLC, doing business as K3 Armory (“K3 Armory,” “we,” “us,” or “our”). They apply to your use of k3armory.com and to every purchase you make from us online, by phone, or in person. By using our website or placing an order, you agree to these Terms, our Privacy Policy, and, if you use our transfer services, our FFL Transfer Policy. If you do not agree, please do not use our website or services.

1. Eligibility and Buyer Responsibilities

By placing an order with K3 Armory, you confirm that:

• You are at least 18 years old, and at least 21 if you are purchasing a handgun, a frame or receiver, any other firearm that is not a rifle or shotgun, or handgun ammunition.
• You are the actual buyer of the items you order and are not buying them on behalf of someone else.
• You are not prohibited by federal, state, or local law from receiving or possessing firearms or ammunition. This includes every category listed on ATF Form 4473 and in 18 U.S.C. § 922(g) and (n), such as being under indictment for or convicted of a felony, a fugitive from justice, an unlawful user of controlled substances, subject to a qualifying protective order, or convicted of a misdemeanor crime of domestic violence.
• You are responsible for knowing and following all federal, state, and local laws that apply to the items you buy, including where you live and where the items will be delivered or used. Many firearms, magazines, and parts sold on this site are restricted or prohibited in some states and localities.
• You will provide accurate information, including a valid phone number, with every order, and you will show government-issued photo ID if we ask for it.
• You will tell us right away if you have any concern about whether an item you ordered is legal for you to own.

We will not sell firearms or ammunition to anyone whose most recent firearm background check was denied or is still in delayed status. We may refuse or cancel any order, at any time, if we believe the sale would violate any law or if we have concerns about the transaction.

2. Buying Firearms

Federal law allows firearms to be shipped only to a holder of a Federal Firearms License (FFL). Firearms purchased on our website can be picked up by appointment at our Midlothian, Virginia location or shipped to a licensed dealer of your choice. Every firearm transfer requires a completed ATF Form 4473, a Virginia State Police Form SP-65, a background check, and our signed Transfer Compliance Acknowledgment and Customer Declaration. Pickups and transfers at our location follow our FFL Transfer Policy, including its ID, appointment, and storage rules.

• Shipping to another dealer. You must choose a receiving FFL that is willing to accept the transfer. We may contact that dealer to verify their license before shipping. We recommend confirming the dealer’s transfer fee and requirements before you order; that fee is paid directly to them.
• If the transfer can’t be completed. If the receiving dealer refuses the transfer, you fail the background check, or the firearm is not legal in your state, the firearm will be returned to us. You will be responsible for return shipping, and the refund will be subject to the cancellation fee in Section 8.
• NFA items. Suppressors, short-barreled rifles and shotguns, and other National Firearms Act items require ATF approval before we can transfer them to you. See our FFL Transfer Policy and NFA service pages for details.

3. Buying Ammunition

You must be at least 18 to purchase rifle or shotgun ammunition and at least 21 to purchase handgun ammunition. Ammunition may only be shipped to addresses where it is legal to receive it, and some states and localities require delivery to a licensed dealer or impose other restrictions. It is your responsibility to know the rules where you live. Always make sure you are using the correct ammunition for your firearm.

4. Used and Consigned Firearms

Used and consigned firearms are sold as is, and all sales are final. Descriptions and photos are provided in good faith, but condition is not guaranteed beyond what is described. Please ask us any questions before you buy.

5. Pricing, Availability, and Errors

We work hard to keep our website accurate, but our inventory changes daily and much of our product information comes from distributors and manufacturers. We do not guarantee that prices, descriptions, images, specifications, or availability are complete, current, or error-free.

• If an item is listed at the wrong price, we will contact you before processing the order. You can accept the correct price or cancel for a full refund.
• If an item is out of stock, or more than one customer orders our last unit, we will honor the first paid order and refund the others in full.
• We may refuse or cancel any order containing a pricing, description, or availability error. If we cancel your order, we will void or fully refund your payment.

Applicable sales tax is added at checkout.

6. Payment

Payments are processed securely through Authorize.Net, a PCI DSS–compliant payment gateway, and our entire website is encrypted with SSL/TLS. We do not store full credit card numbers. You are responsible for paying for every order placed through your account or with your payment information. If you have a problem with an order, please contact us first so we can make it right before you dispute a charge with your card issuer.

7. Shipping and Risk of Loss

Orders ship from our in-store inventory or directly from our distributors’ warehouses, usually within 3 to 10 business days, by UPS, FedEx, or USPS. Some items, including ammunition, may require an adult signature on delivery.

All purchases are made under a shipment contract, which means risk of loss and title pass to you when we or our distributor deliver the item to the carrier. Shipments are insured, and if a package is lost or damaged in transit, we will file a claim with the carrier on your behalf. Please inspect your order on arrival and report any damage or missing items to us within 48 hours of delivery.

8. Returns, Cancellations, and Restocking Fees

• Firearms and ammunition: All sales are final. Once a background check and ATF Form 4473 have been completed, the firearm cannot be returned.
• Items marked “As Is – No Returns”: All sales are final.
• All other items: Returns may be accepted within 14 days of receipt. Contact us first to arrange the return. Items must be unused, unopened, and in the condition you received them. You are responsible for return shipping. Original shipping charges and card processing fees are not refundable, and returns are subject to a 20% restocking fee.
• Cancellations and order changes: We may charge a cancellation or restocking fee of up to 20% of the purchase price for orders canceled or changed after they have been placed.

9. Warranties

New firearms ship in the original manufacturer’s box with the included magazines, accessories, and manufacturer’s warranty. Warranty service is handled by the manufacturer under its own terms, so please contact the manufacturer directly for warranty claims. Except as stated in these Terms or in writing from us, K3 Armory does not provide its own warranty on the products we sell.

10. Our Services

FFL transfers, NFA transfers, consignment, gunsmithing, EFT fingerprinting, gun trusts, and our other services are subject to these Terms and to any additional terms, pricing, and requirements listed on each service’s page and in our FFL Transfer Policy. If those terms conflict with these Terms, the service-specific terms control for that service.

11. Safe and Lawful Use

Firearms and ammunition can be dangerous if used improperly. You agree to follow all manufacturer safety instructions, store firearms securely, and use them only safely, lawfully, and in an appropriate place. You assume all risk of injury or damage arising from the use, misuse, handling, or storage of products you purchase from us.

Lead warning: Handling, cleaning, or firing firearms and ammunition can expose you to lead and other chemicals known to the State of California to cause cancer and birth defects or other reproductive harm. Wash your hands after handling. For more information, visit www.P65Warnings.ca.gov.

12. Your Account

You are responsible for keeping your account login confidential and for all activity under your account. Notify us right away if you believe your account has been used without your permission. We may suspend or close any account that violates these Terms.

13. Acceptable Use of Our Website

You agree not to misuse our website. This includes using bots, scrapers, or automated tools to copy content or prices, attempting to access accounts or systems that aren’t yours, uploading malicious code, interfering with the site’s security or performance, or using the site for any unlawful purpose.

14. Intellectual Property

The K3 Armory name, logo, website design, text, graphics, and original photos are owned by K3 Armory and may not be copied, reproduced, or used without our written permission. Product names, images, and trademarks from manufacturers and distributors belong to their respective owners.

15. Reviews and Submissions

If you post a review, comment, photo, or other content on our website or send us feedback or ideas, you give us permission to use, display, and share it without payment to you. You agree that your content is accurate, lawful, and yours to share. We may remove any content at our discretion.

16. Third-Party Links and Services

Our website links to manufacturers, government agencies, marketplaces such as GunBroker, and other third-party sites and services. We are not responsible for their content, products, policies, or practices.

17. Electronic Communications

When you visit our website, place an order, or email us, you consent to receive communications from us electronically, including by email, phone, text message, and through third-party platforms such as GunBroker. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.

18. Disclaimer of Warranties

OUR WEBSITE AND THE PRODUCTS AND INFORMATION ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, K3 ARMORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THIS DOES NOT AFFECT ANY MANUFACTURER’S WARRANTY.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, K3 ARMORY AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR WEBSITE, SERVICES, OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM.

20. Indemnification

You agree to defend, indemnify, and hold harmless K3 Armory and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your violation of any law, or your use or misuse of any product purchased from us.

21. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms, our website, or your purchases will be brought only in the state or federal courts serving Chesterfield County, Virginia, and you consent to the jurisdiction of those courts.

22. General Terms

These Terms, together with our Privacy Policy, our FFL Transfer Policy, and any terms posted on a specific service page, are the entire agreement between you and K3 Armory. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later. You may not transfer your rights under these Terms without our written consent. We are not responsible for delays caused by events beyond our reasonable control, including carrier delays, distributor shortages, natural disasters, or government actions, including ATF processing times.

23. Changes to These Terms

We may update these Terms from time to time by posting the new version on this page and changing the effective date above. The Terms in effect when you place an order apply to that order. Your continued use of our website after an update means you accept the revised Terms.
