K3 Commerce, LLC, doing business as K3 Armory (“K3 Armory,” “we,” “us,” or “our”), is a federally licensed firearms dealer (FFL/SOT) located at 14712 Ridge Point Drive, Midlothian, Virginia 23112. This Privacy Policy explains what personal information we collect through k3armory.com and our in-person services, how we use and share it, and the choices you have. By using our website or services, you agree to the practices described here.

Because we are a federally licensed firearms dealer, some of the information we collect is required by federal and state law and must be kept and shared as those laws require. We explain those situations below so there are no surprises.

1. Information We Collect

Information you give us:

  • Contact and account information such as your name, email address, phone number, mailing address, and account login when you place an order, create an account, book an appointment, join our email list, or contact us.
  • Order information such as the products and services you purchase, billing and shipping addresses, and your selected FFL dealer.
  • Payment information. Payments are processed by our third-party payment processor. We do not store full credit card numbers on our servers.
  • Firearm transfer information required by law when you purchase or transfer a firearm, including the information you provide on ATF Form 4473 and Virginia State Police Form SP-65 (such as your name, address, date and place of birth, physical description, government ID details, and answers to eligibility questions), and the results of your background check.
  • NFA application information for suppressor and short-barreled rifle transfers, including your electronic fingerprints (.EFT files), passport-style photo, gun trust documents, ATF eForms account details, and the information required on ATF Forms 1, 4, and 5320.23 (Responsible Person Questionnaire).
  • Consignment information such as details about firearms you consign with us, your payout information, and records of the sale.
  • Reviews, surveys, and promotions such as product or service reviews you leave, survey responses, and contest or promotion entries.
  • Communications you send us by email, phone, text, contact form, live chat, or social media.

Information collected automatically: When you visit our website, we and our service providers automatically collect certain technical information, such as your IP address, browser and device type, pages viewed, links clicked, search terms entered on our site, and the site that referred you. We collect this through cookies and similar technologies (see Section 6).

2. How We Use Your Information

  • To process and fulfill orders, transfers, NFA applications, consignments, and other services you request.
  • To verify your identity, age, and legal eligibility to purchase firearms, ammunition, and other age-restricted items.
  • To conduct required background checks and complete required federal and state records.
  • To schedule and manage appointments.
  • To communicate with you about your orders, transfers, appointments, and questions.
  • To send newsletters, promotions, and product updates to customers and subscribers (you can unsubscribe at any time).
  • To ask for ratings and reviews of products and services you’ve purchased, and to run contests, promotions, and surveys.
  • To operate, secure, and improve our website, including preventing fraud and unauthorized activity.
  • To comply with federal, state, and local laws and respond to lawful requests from government agencies.

3. How We Share Your Information

We do not sell your personal information, and we do not share it with third parties for their own marketing. We share information only as described below.

Government agencies, as required by law. As a licensed dealer, we are legally required to:

  • Submit background check information to the Virginia State Police (which coordinates with the FBI’s National Instant Criminal Background Check System) for every firearm transfer.
  • Submit NFA applications, fingerprints, photos, and supporting documents to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and provide copies of NFA applications to your local chief law enforcement officer (CLEO) as federal regulations require.
  • Make our required records available to the ATF during compliance inspections, respond to ATF firearm trace requests, and provide records to law enforcement when we receive a subpoena, warrant, court order, or other lawful request.

Service providers who help us run our business and are allowed to use your information only to perform services for us, including:

  • Our payment processor, to process payments.
  • Fraud prevention services, to screen orders for potential fraud.
  • Product distributors and wholesalers, who ship orders on our behalf (to you or to your FFL dealer).
  • Shipping carriers, to deliver packages.
  • Our website hosting, security, and email providers.
  • Our NFA gun trust partner, when you purchase a gun trust through us.
  • Our analytics provider, Google Analytics.
  • Our email newsletter service, Grow Fish Mail, which runs on Campaign Monitor.

Other FFL dealers, when we ship a firearm to or receive a firearm from another dealer on your behalf, to the extent needed to complete the transfer.

Business transfers. If our business is sold or transferred, your information may be transferred to the new owner, who will be bound by this policy. Firearm transaction records are handled as federal law requires when a licensed business is sold or closes.

To protect rights and safety. We may disclose information when we believe in good faith it is necessary to prevent fraud, protect the safety of any person, or protect our rights or property.

4. Required Firearm Records and Data Retention

Federal law requires us to keep ATF Forms 4473, our firearms acquisition and disposition records, and related transaction records for as long as federal law requires (currently, for the life of our license). When a licensed business closes, these records are transferred to the ATF. We cannot delete, alter, or return these records on request, even if you ask us to delete your other information.

Other personal information, such as your account, order history, and communications, is kept only as long as needed for the purposes described in this policy, to comply with tax and accounting requirements, to resolve disputes, and to enforce our agreements.

5. Your Choices and Rights

  • Access and correction: You may ask us for a copy of the personal information we hold about you or ask us to correct it. You can also update your account information by logging in.
  • Deletion: You may ask us to delete your personal information. We will honor your request except for information we are legally required to keep (see Section 4) or need for a legitimate business purpose such as completing a transaction or preventing fraud.
  • Marketing emails: Use the “unsubscribe” link in any marketing email, or contact us. You will still receive transactional messages about your orders, transfers, and appointments.
  • Cookies: You can block or delete cookies in your browser settings. Some parts of our site, such as the shopping cart and checkout, will not work without cookies.

To make a request, contact us using the information in Section 12. We will respond within 30 days. We may need to verify your identity before fulfilling a request. We will not treat you differently for exercising these rights.

State privacy laws. Residents of some states, including California and Virginia, have additional privacy rights under state law. Based on our size, we are not currently subject to the California Consumer Privacy Act or the Virginia Consumer Data Protection Act, but we will honor the access, correction, and deletion requests described above for all customers, subject to our legal record-keeping obligations. We do not sell personal information or share it for targeted advertising, so there is nothing to opt out of. Nevada residents may submit a request to opt out of the sale of personal information; we do not sell personal information.

6. Cookies and Analytics

Cookies are small files stored on your device. We use:

  • Essential cookies that keep your shopping cart, login, and checkout working, and that help protect our site from attacks.
  • Analytics cookies that help us understand how visitors use our site so we can improve it. We use Google Analytics, which collects information such as pages visited, time on site, and purchases made. You can learn how Google uses this information at policies.google.com and opt out using Google’s browser add-on.

Third-party tracking: Google Analytics may collect information about your online activity over time and across different websites when you visit our site. We do not allow other third parties to collect this information on our site for advertising purposes.

Do Not Track: Our website does not currently respond to “Do Not Track” browser signals, because there is no uniform standard for them.

7. Data Security

We protect your information with reasonable administrative, technical, and physical safeguards, including SSL/HTTPS encryption across our site, secure payment processing, access controls, and physical security for paper firearm records. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as required by law.

8. Customer Portals

For NFA transfers and consignments, we may give you a private link to an online portal where you can submit information and track your status. Please keep your link private; anyone with the link may be able to view its contents. Contact us right away if you believe your link has been shared.

9. Children’s Privacy

Our website and services are intended for adults. You must be at least 18 years old to use our services, and older where the law requires (for example, 21 to purchase a handgun). We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

10. Third-Party Links

Our website links to other sites, such as manufacturers, government agencies, and social media platforms. We are not responsible for the privacy practices of those sites, and we encourage you to read their privacy policies.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the effective date above. If we make material changes, we will post a notice on our website. Your continued use of our website or services after an update means you accept the revised policy.
