This FFL Transfer Policy applies to all K3 Armory transfer services: Inbound FFL Transfers, Private Party Transfers, Outbound Firearm Shipping, and NFA Transfers. Shipping a firearm to us, dropping one off, booking a transfer appointment, or paying a transfer fee means you have read and agree to this policy and to our Terms & Conditions.

1. Fees

Current transfer fees are listed on each service page linked above. Fees are due for every transfer and are not refunded if a background check is denied or an NFA application is disapproved by the ATF. If you prepay and cancel before the firearm arrives at K3 Armory, we will refund your transfer fee. All transfer, shipping, storage, and other fees owed must be paid before we will release or ship any firearm.

2. Appointments

K3 Armory is a home-based business in Midlothian, Virginia, and every pickup, drop-off, and transfer is by appointment only. We do not accept walk-ins. For inbound and NFA transfers, please wait until we notify you that your firearm has arrived, then book your appointment on our online scheduling page. Please don’t call or email to request a time.

You’ll receive a confirmation when you book and a reminder 24 hours before your appointment. Your time slot is reserved just for you, so please arrive on time. If you’re running late or can’t make it, contact us as soon as possible to reschedule. We may charge a $10 fee for each late arrival, missed appointment, or no-show, payable before your firearm is released.

3. Eligibility, ID, and Background Checks

  • Every transfer requires a completed ATF Form 4473, a Virginia State Police Form SP-65, and a background check through the Virginia State Police, which also checks the FBI’s National Instant Criminal Background Check System (NICS). There are no exceptions.
  • Compliance acknowledgment. Before every transfer, you must read, initial, and sign our Compliance Acknowledgment and Customer Declaration. We will not complete a transfer without it.
  • ID. You must bring a valid, unexpired, government-issued photo ID that shows your current address and was issued at least 30 days before your transfer. We will not accept an ID that is expired or appears altered. Residency and second-ID requirements for each service are listed on its service page.
  • Age and residency. You must be at least 21 to receive a handgun, frame, receiver, or other non-long-gun firearm, and at least 18 to receive a rifle or shotgun. Non-Virginia residents may receive long guns only.
  • Actual buyer only. The person completing the transfer must be the actual buyer. We will refuse a transfer if someone else appears to be directing or paying for the purchase, if you can’t describe the firearm you’re buying, or if you indicate it is for someone else.
  • Assault firearms and magazines. We do not accept, receive, or transfer any firearm classified as an “assault firearm” under Virginia HB217/SB749, or any magazine that holds more than 15 rounds. This applies no matter where the item was purchased, what it will be used for, or whether any court injunction is in place.

Delayed checks: We only transfer firearms after receiving an approval from the Virginia State Police. Virginia law allows dealers to complete a transfer if no response is received by the end of the fifth business day, but it does not require it, and as a matter of policy K3 Armory does not. We’ll hold the firearm until an approval comes through, and no storage fees accrue while a check is delayed. A background check is valid for only 30 days. If no approval is received in that time, we can run a new check at your next appointment, or you may have the firearm returned to the seller at your expense.

Denied checks: If your background check is denied, we cannot legally release the firearm to you. For inbound transfers, it will be returned to the seller or shipping dealer, and you will be charged our $10 return processing fee plus actual shipping and insurance costs, in addition to the transfer fee. K3 Armory does not approve or deny transfers; those decisions are made by the Virginia State Police and the FBI.

4. Inbound Transfers

  • We accept firearm shipments only from licensed dealers, manufacturers, and distributors. We do not accept firearms shipped by private individuals.
  • Before ordering, confirm with us that we can accept the item and that it is legal for you to own. Any item we can’t accept, including an assault firearm or a magazine holding more than 15 rounds, will be returned to the seller at your expense.
  • NFA items (suppressors, short-barreled rifles, and other National Firearms Act items) must be shipped to us on an approved ATF Form 3 and go through our NFA transfer process in Section 8, not a standard inbound transfer.
  • If you cancel a transfer after the firearm arrives and want it returned to the seller, you’ll pay our $10 return processing fee plus actual shipping and insurance costs.

5. Private Party Transfers

  • Private party transfers are available only when both the buyer and seller are Virginia residents. For out-of-state buyers, use our Outbound Firearm Shipping service.
  • The buyer and seller must attend the appointment together, each with valid ID, and the seller must bring the firearm unloaded and cased.
  • K3 Armory is not a party to the sale. The price, payment, and condition of the firearm are strictly between the buyer and seller, and we do not inspect, value, or guarantee the firearm.
  • Only the buyer goes through the background check. If it is delayed, the seller may take the firearm home or leave it with us until the check is resolved. If it is denied, the sale cannot proceed and the firearm goes back to the seller. The transfer fee is due either way.

6. Outbound Shipping

  • We ship firearms only to licensed dealers. We will not ship until the receiving dealer has provided a copy of its current FFL, and, for NFA items, its SOT and an approved ATF transfer form. We never ship firearms to individuals.
  • Bring the firearm and a completed Outbound Shipping Service form (download it from our Outbound Firearm Shipping page) to your drop-off appointment. We’ll pack and weigh it, give you a shipping quote, and collect the service fee plus actual shipping and insurance costs before it ships.
  • Every package ships with signature-required delivery. Insurance is optional but recommended. If your shipment is insured and is lost or damaged, we’ll file a claim with the carrier on your behalf, but the outcome is up to the carrier. K3 Armory is not responsible for loss or damage in transit.
  • If the receiving dealer refuses the shipment or the buyer can’t complete their transfer, any return shipping is your responsibility.

7. Storage and Abandoned Firearms

Our storage space is limited. After we notify you that your firearm is ready, you have 30 days to pick it up free of charge. Starting on day 31, a storage fee of $5 per day applies unless we’ve agreed to other arrangements in writing. We’ll use every contact method you’ve given us to let you know your firearm is ready.

A firearm not picked up within 90 days after our first notice, with no arrangements made, will be considered abandoned. K3 Armory may then claim a lien for all unpaid fees and lawfully dispose of the firearm, including selling it through proper FFL channels, to recover what is owed. Any proceeds beyond the amount owed will be held for you for 180 days and then reported and remitted to the Virginia Department of the Treasury’s Unclaimed Property Division as state law requires. We reserve all legal remedies to collect unpaid fees.

8. NFA Transfers

  • Federal law prohibits you from taking possession of an NFA item until the ATF approves your transfer. Approval times are set by the ATF, vary widely, and are outside our control.
  • We store your NFA item at no charge while your application is pending. Once we notify you that your application is approved, the storage terms in Section 7 apply, starting from that notice.
  • If the ATF disapproves your application, we’ll contact you to discuss your options, which may include correcting and resubmitting it, consigning the item with us, or transferring it to another eligible buyer or dealer. Transfer fees are not refunded.
  • You are responsible for giving us complete and accurate information for your application, including your ATF eForms username and PIN, fingerprints, photo, and trust documents if applicable.

9. Inspection, Damage, and Returns

We do not inspect, test fire, or verify the condition of firearms we transfer. Please inspect your firearm thoroughly before you complete the transfer. If a firearm arrives damaged, is the wrong item, or has been misrepresented, don’t take possession of it. Contact the seller right away to arrange a resolution. Any shipping back to the seller is your responsibility. We may refuse or return any firearm that was misrepresented, at the buyer’s expense.

K3 Armory is not liable for defects, damage, or malfunctions in firearms transferred to or from third parties. Once a transfer is complete, federal regulations prevent us from accepting the firearm back, and any warranty or repair work must be arranged directly with the manufacturer or seller.

10. Right to Refuse

We may refuse any transfer, shipment, or sale that we believe would violate federal, state, or local law, or if we suspect fraud, a straw purchase, trafficking, or other criminal activity, even if a background check would otherwise be approved. We will report suspected criminal activity to the appropriate law enforcement agencies.

11. Visiting Our Location

K3 Armory operates from a private residence. By entering our premises, you agree to follow our instructions, keep all firearms unloaded and cased unless we ask otherwise, and supervise anyone who comes with you. To the fullest extent permitted by law, you assume the risks of visiting our location and release K3 Commerce, LLC (dba K3 Armory) and its owners, employees, and agents from claims for injury, loss, or damage arising from your visit.
