Private Party Sale FFL Transfer FAQs

What is an "Private Party Sale" FFL Transfer?

Virginia’s new Universal Background Check law requires that any Virginia resident who wishes to sell a firearm to another person, must have a background and criminal history check performed on the buyer before he/she can obtain the weapon. These transactions are commonly referred to as “private party” or “person to person” local gun sales.

K3 Armory is one of the select Virginia-based FFL Dealers that facilitates these newly required FFL Transfers for firearm sales/transactions between two private party individuals.

Both parties will visit our location in Chesterfield, VA with the firearm and the necessary identification required to complete an FFL Transfer between them. Once the paperwork is completed by both parties, the Buyer has passed the required background check and paid the FFL Transfer fee; the firearm will be "transferred" to the new owner and the transaction is complete.

This is New - Why do We Have to do This Now?

Starting July 1, 2020 Virginia’s new Universal Background Check law went into effect (Senate Bill 70 and House Bill 2). This law requires that ANY Virginia resident who wishes to sell a firearm to ANY other Virginia resident; conduct a background and criminal history check on the Buyer.

Since typical private party Sellers (who are not FFL Dealers), do not have the ability to conduct complete background checks on potential Buyers, a licensed FFL Dealer like K3 Armory is required to facilitate the transaction.

This Infringes on my 2A Rights - What if I Sell/Buy Anyways?

A person who sells a firearm to another person without obtaining the required background check is guilty of a Class 1 misdemeanor. A purchaser who receives a firearm from another person without obtaining the required background check is guilty of a Class 1 misdemeanor as well.

Who can request a transfer?

Federal law requires that you can only arrange a transfer for yourself. The Buyer OR Seller of any private party transaction must contact us to initiate the transfer between them.

• For handguns, pistols and lower receivers:
We only facilitate private party sale transfer services to buyers that are at least 21 years old AND legal Virginia residents (or active duty military personnel that are PCS to a base or station in Virginia).

• For long guns, rifles and shotguns:
We only facilitate private party sale transfer services to buyers that are at least 18 years old AND legal Virginia residents.

Private party sale FFL Transfers are not available to non-Virginia residents.

Is K3 Armory Involved in the Negotiating of my Private Gun Sale/Purchase?

No! K3 Armory will not participate in, negotiate or handle any payments between the private party individuals (the Seller and Buyer). Our purpose in the process is to ONLY complete the proper paperwork and run the background check on the Buyer.

The Seller and Buyer of the firearm should communicate privately and come to an agreement regarding the cost and all terms of the sale.

Same as before, all terms of the sale and actual exchange of funds/goods/services for the firearm being sold should be handled privately between the Buyer and Seller - completely independent of the K3 Armory.

We recommend that the Seller and Buyer fill out and exchange a private party firearm "Bill of Sale". This will include basic information on both parties and provide written proof of the transaction. Templates can easily be found online that are free to download. THIS IS NOT PROVIDED BY K3 ARMORY.

What Form of ID Will I Need?

Before arriving at K3 Armory for their scheduled Private Party Sale FFL Transfer appointment, both Buyer and Seller should ensure that they have the necessary identification and documents that will be required to complete the transfer.

SELLERS: The Seller/Owner of the firearm to be transferred must be a current Virginia resident. They will need to bring the firearm along with a valid, Virginia DMV issued photo ID that includes their current address.

BUYERS: The Buyer/Receiver of the firearm to be transferred must be a current Virginia resident as well. The same rules and regulations and ID requirements will apply - just as any other sale conducted by an FFL Dealer in a traditional retail firearm purchase.

• For handguns, pistols and lower receivers; Buyers need ALL of the following:

  1. Must be at least 21 years old.
  2. Must be a Virginia resident or active duty military personnel that are PCS to a base or station in Virginia.
  3. Virginia drivers license (or Virginia DMV issued identification card) with your current address. The original Issue Date must be older than 30 days. If it does not have your current address, then a change of address card must be presented.
  4. If you are active-duty military and are stationed in Virginia, you will need your home state drivers license, your active duty military photo ID card issued by the United States Department of Defense and a copy of your current orders that PCS you to a base in Virginia and they must not have exceeded their stated rotation date.
  5. Must complete ATF paperwork and pass a background check.
  6. A second form of ID is required to confirm Virginia residency.

• For long guns, rifles and shotguns; Buyers need ALL of the following:

  1. Must be at least 18 years old.
  2. Must be a Virginia resident or active duty military personnel that are PCS to a base or station in Virginia.
  3. If you are active-duty military and are stationed in Virginia, you will need your home state drivers license, your active duty military photo ID card issued by the United States Department of Defense and a copy of your current orders that PCS you to a base in Virginia and they must not have exceeded their stated rotation date.
  4. Must complete ATF paperwork and pass a background check.
  5. A second form of ID is required to confrm Virginia residency.

How Much Does a Transfer Cost Us?

K3 Armory offers 3 types of transfer services:

  1. Inbound FFL Transfers:
    • $40 for Virginia residents.
    • $50 for out-of-state residents.
    • Additional weapons that are part of the same sale have a reduced $10 transfer fee each.

  2. Private Party Sale FFL Transfers (VA residents only):
    • $40 for Virginia residents.
    • Additional weapons that are part of the same sale have a reduced $10 transfer fee each.

  3. Outbound FFL Transfers:
    • $25 for Virginia residents plus cost of acutal shipping/handling (per destination address/FFL Dealer).
    • Additional weapons that are part of the same sale have a reduced $10 transfer fee each.

How do We Schedule an Appointment to Transfer the Firearm Between Us?

FFL Transfers are by appointment only. Please do not call or email us for an appointment time. ONCE YOU ARE INSTRUCTED TO DO SO, the Seller or Buyer can visit our online scheduling page to book your Private Party Sale FFL Transfer appointment.

Appointments take place at our home office in Chesterfield, VA. We are located near Hwy 360/Hull Street and Hwy 288. They are booked in 30 min time slots. Both parties need to arrive on time.

It is recommend that both Parties can come in at the same time (for the same scheduled appointment time). However, if necessary the Seller can schedule their own appointment to drop off the firearm. The Buyer can schedule their own appointment to come in separately at a latter time to complete the transfer. Be advised that additional steps and costs may be required for Sellers in this situation - please contact us before making your separate appointments.

What Should We Expect During our Transfer Appointment?

The Seller/Owner of the firearm to be transferred will provide it to K3 Armory along with proper identification. We will receive the firearm and log it into our ATF record keeping book. At this point the firearm has been legally transferred to K3 Armory.

The Buyer will then present the proper identification and fill out an ATF Form 4473 and Virginia State Police Form SP-65. the federal and state firearm purchase forms and K3 Armory will then complete a background and criminal history check on the prospective Buyer.

Form 4473 and SP-65 rquires information about the identity of the Buyer and it requires answers to a series of questions to ensure that the Buyer is not a prohibited person. Upon completing these forms, K3 Armory will conduct a federal background and criminal history check on the Buyer through the Virginia State Police's VCheck and ATF's National Instant Criminal Check System (NICS).

Once the paperwork is completed by both parties and the Buyer has passed the required background check and paid the FFL Transfer fee; the firearm will be transferred to the new owner and the transaction is complete.

Is a Background Check Required?

Yes, of course! All firearm purchases - EVEN PRIVATE PARTY TRANSACTIONS between two individuals - now require a complete background check to be completed on the Buyer by an FFL Dealer prior to the exchange of ownership. There are NO exceptions.

Can I Pass A Background Check?

Refer to the ATF's list of Prohibited Persons and the Virginia State Police Firearms Purchase Eligibility Test to confirm if you are eligible to purchase and/or possess a firearm.
